{"id":2069,"date":"2026-06-18T23:07:57","date_gmt":"2026-06-18T23:07:57","guid":{"rendered":"https:\/\/americanmovershub.com\/?p=2069"},"modified":"2026-06-18T23:07:57","modified_gmt":"2026-06-18T23:07:57","slug":"how-the-education-department-continues-to-march-to-a-trump-ordered-demise","status":"publish","type":"post","link":"https:\/\/americanmovershub.com\/?p=2069","title":{"rendered":"How the Education Department continues to march to a Trump-ordered demise"},"content":{"rendered":"<div>\n<div>\n<div>\n<div>KEY POINTS<\/div>\n<\/div>\n<div>\n<ul>\n<li>The U.S. Education Department is shifting oversight of special education and civil rights to other federal agencies.<\/li>\n<li>The operational changes are the latest in a period of historic disruption at the Education Department.<\/li>\n<li>President Donald Trump has called for the dismantling of the 46-year-old federal agency \u2014 asserting public education is best managed by states.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<p>When President Donald Trump appointed Linda McMahon to lead the Education Department last year, he issued his new Cabinet hire an unusual task: \u201cPut (yourself) out of a job.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/americanmovershub.com\/?p=2067\">Fans crowd the streets of New York for Knicks\u2019 parade<\/a><\/p>\n<p>Unusual, yes \u2014 but not surprising.<\/p>\n<p>Long before being reelected, Trump pledged to scrap the 46-year-old federal agency \u2014 calling it \u201ca big con job,\u201d while insisting education is best managed by states rather than Washington, D.C.<\/p>\n<p>Ultimately, it\u2019s up to Congress if or when to shelve the Department of Education, but McMahon continues to follow her boss\u2019 wish to diminish the reach of the embattled agency.<\/p>\n<p>This week, the DOE announced it was moving two of its most important oversight functions \u2014 special education and civil rights enforcement \u2014 to other federal offices.<\/p>\n<p>Over the past year, the DOE has shifted several duties to other agencies \u2014 including repositioning a portion of its student loan portfolio to the Treasury Department and administrative duties of other key programs to federal agencies such as the departments of Labor, Interior, Health and Human Service, and State.<\/p>\n<p>The latest round of interagency agreements includes the DOE partnering with HHS on special education and rehabilitative services, and with the Department of Justice on civil rights enforcement.<\/p>\n<p>McMahon said this week\u2019s operational announcements signal ongoing efforts to scale back \u201cfederal micromanagement,\u201d while bolstering federal oversight efficacy.<\/p>\n<p>\u201cThrough our partnership with HHS, we will align federal services with the goal of strengthening academic outcomes and supporting individuals with disabilities so that they can achieve greater independence, key life skills, and meaningful employment,\u201d McMahon said in a DOE release.<\/p>\n<p>The DOE\u2019s new partnership with the DOJ, added McMahon, ensures stronger civil rights enforcement in the nation\u2019s K-12 and higher education campuses.<\/p>\n<p>\u201cThese agreements align federal responsibilities with the agencies best positioned to support them, strengthening the effectiveness and impact of critical services,\u201d she said.<\/p>\n<h3>Trump administration: School kids with disabilities will continue to be protected<\/h3>\n<p>All protections and responsibilities guaranteed to American families under the Disabilities Education Act, or IDEA, will continue, according to aoutlining details of the DOE and HHS partnership.<\/p>\n<p>IDEA ensures that kids with disabilities have access to a free, public education that\u2019s modified to meet their unique needs.<\/p>\n<p>The Trump administration, according to the DOE release, remains committed to carrying out the federal government\u2019s duty to enforce IDEA while investing in support for individuals with disabilities.<\/p>\n<p>The new DOE\/HHS interagency agreement won\u2019t alter that obligation, the report added.<\/p>\n<p>\u201cThrough this partnership, HHS and the Department of Education will cut bureaucratic barriers, better align federal resources, and deliver more effective support for individuals with disabilities and their families,\u201d said Secretary of Health and Human Services Robert F. Kennedy Jr. in the DOE release.<\/p>\n<p>\u201cTogether, we will improve education and employment outcomes, uphold the rights of individuals with disabilities, and help every child reach their full potential.\u201d <\/p>\n<p>But some advocates worry shifting duties from the DOE to HHS could complicate the process of protecting the rights of students with disabilities.<\/p>\n<p>The Associated Press offered this example: If a student with a disability is denied school accommodations, his or her parents can often appeal to a single federal agency \u2014 the DOE \u2014 to handle the violation. Now, parents might have to navigate multiple bureaucratic systems to get answers.<\/p>\n<p>Read more <a href=\"https:\/\/americanmovershub.com\/?p=2065\">Updated: Case dismissed against former BYU football player after judge denies delay of July trial<\/a><\/p>\n<p>Advocates, added The Associated Press, also worry that special education work transferred from the DOE to HHS would result in students with disabilities being viewed through \u201ca medical lens\u201d and not in terms of the educational needs.<\/p>\n<p>In a medical model, \u201cdisability is treated as a diagnosis to manage instead of a natural part of human life,\u201d Robyn Linscott, who directs education policy at The Arc of the United States, a major disability rights group, told The Associated Press.<\/p>\n<p>\u201cWhen that mindset drives education decisions, students are more likely to be segregated, underestimated or treated as separate from the school community.\u201d<\/p>\n<h3>More headlines for the DOE\u2019s Office for Civil Rights<\/h3>\n<p>The new partnership between the DOE and the DOJ aims to provide more responsive enforcement of civil rights law \u2014 combining the two agencies\u2019 capacities to bolster evaluation, investigation, resolution of complaints and to \u201cenforce critical protections for all students.\u201d<\/p>\n<p>In the DOE release, Acting Attorney General Todd Blanche said the partnership will ensure that discrimination on the basis of race, sex or ability \u201cwill not be tolerated\u201d in schools.<\/p>\n<p>\u201cTogether,\u201d said Blanche, \u201cwe are advancing a national commitment to ensuring every student is treated with dignity and has an equal opportunity to succeed both in the classroom and on the court or field.\u201d<\/p>\n<p>added that the two agencies will \u201cpursue vigorous enforcement of civil rights laws\u201d to ensure that educational institutions receiving federal dollars comply with civil rights law.<\/p>\n<p>The DOE\/DOJ partnership will not impact students, parents or families who believe they have experienced discrimination, added the fact sheet.<\/p>\n<p>The Education Department\u2019s Office for Civil Rights has been one of the agency\u2019s most controversial elements during a time of massive DOE disruption since Trump returned to the White House.<\/p>\n<p>Despite sweeping layoffs at the DOE, the agency has aggressively utilized its civil rights office to go after schools they accuse of discriminatory or \u201cwoke practices.\u201d<\/p>\n<p>Last March, for example, the DOE\u2019s civil rights office initiated a Title IX investigation of a Wisconsin school district following reports that the district was allowing \u201cbiological men to use female restrooms\u201d based on students\u2019 \u201cgender identity.\u201d<\/p>\n<p>The department has also taken high-profile action against San Jose State University for \u201callowing a male to compete on the women\u2019s volleyball team.\u201d<\/p>\n<p>One of the DOE\u2019s most powerful tools is the ability to pull federal funding from schools that violate civil rights laws. Facing that threat, schools usually have agreed to make changes when pressed by the agency.<\/p>\n<p>The department\u2019s investigative arm also reached into the Beehive State last year when it alleged the University of Utah and dozens of other higher education institutions were practicing \u201cracial preferences and stereotypes in education programs and activities.\u201d<\/p>\n<p>The DOE announced it was investigating Utah\u2019s flagship university and 44 other American schools for allegedly violating Title VI of the Civil Rights Act (1964) by partnering with \u201cThe Ph.D. Project\u201d \u2014 an organization \u201cthat purports to provide doctoral students with insights into obtaining a Ph.D. and networking opportunities, but limits eligibility based on the race of participants,\u201d according to the DOE.<\/p>\n<p>The University of Utah later settled with the DOE\u2019s Office of Civil Rights after terminating its partnership with The Ph.D. Project. <\/p>\n<p>Read more <a href=\"https:\/\/americanmovershub.com\/?p=2063\">This Real Salt Lake star now has his own reality show<\/a><\/p>\n<p>The Utah school\u2019s connection with the organization was fairly limited.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Rapidly diminished Cabinet-level agency announces oversight changes to special education and civil rights enforcement<\/p>\n","protected":false},"author":1,"featured_media":2068,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5],"tags":[],"class_list":["post-2069","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-utah"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
