Meanwhile, Chile has pending legislation to prohibit and criminalize all forms of surrogacy. <\/p>\n<p>Other countries, including Slovakia, Germany, Austria, Finland and Norway, have made surrogacy illegal. <\/p>\n<div>\n<div>Surrogacy is defined as a contract by which one or more sponsors agree with a woman that she will bear one or more children with a view of handing them over at birth.<\/p>\n<\/div>\n<\/div>\n<p>At the Alliance Defending Freedom-moderated event, Eugenia Roccella, the Italian minister for family, natality and equal opportunity, described surrogacy as a global issue, which is \u201cincreasingly shaped by international markets, cross-border arrangements and profound inequalities within and between societies.\u201d <\/p>\n<blockquote>\n<p>We must preserve female-specific and mother-specific language and provide legal, social and economic protections for mothers<\/p>\n<p><span>\u2014 \u00a0<!-- -->Special Rapporteur Reem Alsalem<\/span><\/p><\/blockquote>\n<p>Felipe Kipreos Palau, Chile\u2019s director of human rights of the Ministry of Foreign Affairs, added, \u201cThe growing globalization of surrogacy arrangements, particularly commercial and cross-border practices, has generated complex legal, ethical and human rights questions.\u201d <\/p>\n<h3>U.N. council asked to classify surrogacy as human trafficking<\/h3>\n<p>Debate surrounding surrogacy continued later at the EU\u2019s official Human Rights Council session in Geneva, Switzerland on Monday. <\/p>\n<p>Special Rapporteur Reem Alsalem asked the council to adopt a definition of the word mother, which is directly tied to female reproduction. <\/p>\n<p>\u201cWe must preserve female-specific and mother-specific language and provide legal, social and economic protections for mothers,\u201d she said. <\/p>\n<p>Meanwhile, Olivia Sarton, the legal director of Juristes Pour L\u2019enfance, asked the council to classify all cases of surrogacy as human trafficking. <\/p>\n<p>Read more <a href=\"https:\/\/americanmovershub.com\/?p=2541\">What we\u2019re watching for in Utah\u2019s congressional primaries<\/a><\/p>\n<p>\u201cRegardless of the legal framing chosen by the contracting parties, surrogacy always constitutes trafficking of the child, who is the subject of contract to which they are not a party, even though they will bear the consequences for their entire life,\u201d Sarton said. <\/p>\n<p>She continued, \u201cThe child is treated as an object of property rights, since the parties agree on ordering the child and then hand them over once they become a \u2018finished product.\u2019\u201d<\/p>\n<p>Sarton said surrogacy not only constitutes the commodification of children but of mothers as well. \u201cSurrogacy is also always an exploitation of women, who are viewed as \u2018body-resources\u2019 to produce a child and hand them over to the commissioning party,\u201d she said, adding that a surrogate mother\u2019s consent \u201ccan in no way legitimize a relationship based on structural exploitation.\u201d <\/p>\n<p>Several minutes later, a spokeswoman for the France-based organization La Manif Pour Tous added, \u201cSurrogacy is contrary to international commitments and fundamental text of the United Nations.\u201d <\/p>\n<p>\u201cWhatever form (surrogacy) takes, it is always based on one single principle: the use of a woman to obtain a child from her for the benefit of third parties,\u201d she said. <\/p>\n<p>\u201cWe demand you recognize reproductive exploitation, especially surrogacy in all of its forms as a form of trafficking and draw the necessary consequences,\u201d a Manif Pour Tous spokeswoman concluded. <\/p>\n<h3>Ireland and others push back on the criticisms of surrogacy<\/h3>\n<p>On behalf of 26 EU member states, Ireland pushed back against the requests for more rigid guidelines globally around surrogacy. <\/p>\n<p>In Ireland, noncommercial surrogacy has been legal since 2024. <\/p>\n<p>Ireland\u2019s representative argued that regulations on surrogacy would \u201ceras(e) diverse realities\u201d and \u201creinforce gender stereotypes that contribute to discrimination and violence.\u201d<\/p>\n<p>She continued, \u201cWe underscore that pregnancy and parenthood must never be grounds for discrimination.\u201d <\/p>\n<p>A representative from Canada said her country was concerned about Alsalem\u2019s proposed definition of a mother. \u201cLaws and policies must be consistent with international human rights standards including equality, nondiscrimination and inclusivity,\u201d she said. <\/p>\n<p>Mexico\u2019s representative similarly criticized Alsalem\u2019s definition.
