Hello, friends. <\/b>We are in the thick of the dog days of summer, and things are getting hot (and sticky) here in Washington. One lawmaker is even pleading with Capitol staffers to remember to shower. <\/p>\n

We\u2019re inching closer <\/b>to the annual August recess where the House and Senate will be out of session until the first week of September. Republicans are racing to get some of their top priorities done before then. <\/p>\n

Chief among the list: <\/b>the SAVE America Act. But is it already too late for them to get that done before the midterms?<\/p>\n

The Big Idea: Is the SAVE America Act running out of time?<\/h3>\n

Republicans are getting anxious<\/b> to pass the SAVE America Act. House GOP leaders are planning to attach the proof-of-citizenship and voter ID bill to every must-pass piece of legislation they send to the Senate. <\/p>\n

They\u2019re hoping to get some provisions<\/b> passed through a partisan budget procedure in the Senate. And they have President Donald Trump using every opportunity he gets to promote the legislation during his speeches. <\/p>\n

Trump has really wanted<\/b> to get SAVE America Act \u2014 the main priority of which is to remove noncitizens from voter rolls \u2014 done before the midterms. That timeline was ambitious even at the start of this year. <\/p>\n

But time is running out, <\/b>and it might not even be possible at this point. <\/p>\n

The National Voter Registration Act<\/b>dictates that when a state administers a program to \u201csystematically remove the names of ineligible voters from the official lists of eligible voters,\u201d it has to be done 90 days before a primary or general election. Election Day is on Nov. 3, so that deadline would be the first full week of August. <\/p>\n

And while Congress has the authority to set the parameters of elections, Utah Sen. Mike Lee<\/b> has acknowledged that it would be \u201cdifficult to implement major changes without giving states enough time to abide by them.\u201d<\/p>\n

\u201cIf we want to ensure citizen-only voting in 2026, we need a runway for states to comply,\u201d he told me.<\/p>\n

Remember: <\/b>The House is scheduled to leave July 23 and not return until the first week of September. The Senate will still be here the first week of August, coinciding with that deadline, but then they leave until mid-September. <\/p>\n

So time is not on their side. <\/b>And the math that has stalled the SAVE America Act in the Senate \u2014 60 votes to overcome the filibuster, which would require Democrats, who staunchly oppose \u2014 has not changed. <\/p>\n

Lee has suggested <\/b>keeping the Senate in session until the election bill is passed, even if that means delaying the recess period.<\/p>\n

\u201cI would happily give up August recess<\/b> if it means a real fight to pass the SAVE America Act. American voters want to see us fight for them, and tend to reward people and parties who do,\u201d Lee said.<\/p>\n

But Senate GOP leaders<\/b> don\u2019t seem to be convinced, noting they just don\u2019t see a pathway.<\/p>\n

\u201cWell, if I thought there was a path to getting a positive result or a positive outcome, I\u2019d want to do just about anything, as I think we all would here, in favor of the SAVE America Act,\u201d Senate Majority Leader John Thune<\/b>, R-S.D., said on Wednesday. \u201cThe folks that have consistently blocked it and voted against it are all the Democrats in the Senate. I think that\u2019s unlikely to change, and it\u2019s also very unlikely that Senate Republicans are going to vote to get rid of the legislative filibuster.\u201d<\/p>\n

Some other Republicans<\/b> have pointed out that even if the bill were to pass tomorrow, it\u2019d be almost impossible to implement those changes \u2014 especially in states where election administration procedures are already underway.<\/p>\n

\u201cDo y\u2019all have any idea how many governmental entities have to implement these changes before November? More than 10,000. \u2026 If we had passed this last year, it couldn\u2019t have been implemented in time,\u201d Sen. Thom Tillis,<\/b> R-N.C., said this week. \u201cThey\u2019re being disingenuous to suggest to the American people they could possibly be operational by this election. And so then it begins to make me wonder … if we\u2019re just beginning to undermine the underlying integrity of any of our elections.\u201d<\/p>\n

\u201cI think that\u2019s dangerous<\/b> and I think that\u2019s wrong,\u201d he added. <\/p>\n

But just because it may not be done in time<\/b> for the midterms doesn\u2019t mean Republicans are ready to give up on it. <\/p>\n

\u201cIn some ways, the process is already getting started for 2026. But you don\u2019t pass a piece of legislation because you think you\u2019re going to immediately benefit from it,\u201d Vice President JD Vance<\/b> told us reporters in the Capitol this week. \u201cYou pass a piece of legislation because you think the American people are going to benefit from it over the long haul. We have to do it. SAVE America is not mainly about 2026. It\u2019s actually about saving America\u2019s elections well into the future.\u201d<\/p>\n

Lee, for his part, <\/b>tells me he has no plans of giving up. <\/p>\n

\u201cThe best time to pass SAVE <\/b>was two years ago, the next best time is today, and the third best time is tomorrow,\u201d Lee said. \u201cI don\u2019t mind making Democrats defend the indefensible \u2014 their opposition to proof of citizenship for voting \u2014 between now and November. But as Vice President Vance recently said, this is bigger than the 2026 elections: It\u2019s about securing America\u2019s elections for generations to come.\u201d<\/p>\n

That means continuing his pressure campaign<\/b> to revive the talking filibuster and undergo marathon debate until Democrats fold, a strategy that some Republicans say wouldn\u2019t work, and pushing to add the bill to other legislation. House Republicans have been heavily hitting that second option, attaching SAVE to must-pass spending bills and other bills to try and ensure its passage. <\/p>\n

\u201cI favor an \u2018all the above\u2019 approach,\u201d <\/b>he told me. \u201cWe should be willing to exhaust Democrat obstruction through a talking filibuster, while at the same time putting the broccoli back on their plate by including SAVE in major must-pass bills until they\u2019re forced to eat it.\u201d<\/p>\n

  2. Election preview:<\/b> Vice President JD Vance assured reporters on Wednesday that Republicans will accept the results of the midterm elections in November even if Congress doesn\u2019t pass sweeping legislation to enact proof-of-citizenship and voter ID requirements.<\/li>\n
  3. Warring factions:<\/b> Utah Sen. John Curtis said Congress must assert its authority on whether to declare war in Iran just days after Trump notified lawmakers that military operations have been restarted. Curtis suggested the resumed operations do not restart the 60-day clock as a new conflict.<\/li>\n<\/ol>\n

    House Republicans want to punt government funding until after midterms<\/h3>\n

    The House<\/b> could vote on a resolution to extend government funding levels until after the midterm elections as GOP leaders hope to avoid another shutdown fight while they fight to defend their slim majority. <\/p>\n

    House Speaker Mike Johnson,<\/b> R-La., confirmed on Thursday that the \u201ccurrent plan\u201d is to put the funding extension, known as a continuing resolution, or CR, on the floor next week \u2014 2\u00bd months before the Oct. 1 deadline. It\u2019s not clear how successful Johnson\u2019s gambit will be, as some of his conservative members continue their blockade over the SAVE America Act,<\/b> but it underscores Republicans\u2019 desires to take a threat of a government shutdown off the table heading into November. <\/p>\n

    House Appropriations Committee Chairman Tom Cole,<\/b> R-Okla., said he thought that plan was a \u201cgood idea\u201d and that he imagines the resolution will be \u201ca very clean CR.\u201d Meaning, it will just have funding attached and no unrelated policies. <\/p>\n

    It also isn\u2019t clear<\/b> how long lawmakers will seek to extend government funding, but Cole predicted it would be before the end of the year \u2014 likely around Thanksgiving, he said. <\/p>\n

    This strategy is also beginning to take foot in the Senate. As I\u2019ve previously reported, Sen. Rick Scott,<\/b> R-Fla., is circulating a plan to other Senate Republicans to consider passing a continuing resolution to extend spending until after the midterm elections, hoping that it won\u2019t snarl campaigns. <\/p>\n

    Of course,<\/b> this plan would need buy-in from Democrats in the Senate \u2014 who Scott says don\u2019t want to help keep the government open.<\/p>\n

    And to be fair, who knows what the appetite for Democrats will be. Senate Minority Leader Chuck Schumer<\/b>, D-N.Y., told reporters this week that President Donald Trump is the one who is threatening a September shutdown, and that Democrats want to keep the government funded. <\/p>\n

    \u201cRepublicans have been trying<\/b> to say we want a shutdown. We don\u2019t. We\u2019ve been fighting it,\u201d Schumer said. \u201cTrump said the quiet part out loud. He\u2019s willing to shut down the government to get his way. Democrats want to fund the government, avoid a shutdown, but that requires bipartisan, serious negotiations, not lopsided partisan spending bills that pour more taxpayer money into Trump\u2019s disastrous war (and) will do nothing to lower costs for working families.\u201d<\/p>\n

    An update on where we\u2019re at: <\/b>Only three of the 12 annual appropriations bills have been passed by the House, and the remaining nine have been approved by committees and are awaiting a final vote. None have been passed in the Senate or approved by individual committees.<\/p>\n

    Each bill needs to be identical<\/b> and passed by both chambers before they can go to the White House for Trump\u2019s approval.<\/p>\n

    The House <\/b>returns on Monday afternoon as GOP leaders hope to tee up votes on government funding as well as the party\u2019s latest defense supplemental resolution. The Senate <\/b>will return to pending nominations, including whether to advance Trump\u2019s pick for attorney general. <\/p>\n
